Best to ask this question in "Prospecting Rules and Regulations" and ask in relation to the State you are interested in, as the rules vary in each state.

My understanding is -:
  • Yes highbankers are legal in every state and territory of Australia, some others have interpreted the laws and regulations differently including reports of officers of regulatory departments saying they are not legal in some states.[/*]
  • for recreational prospecting you are limited to using only hand tools for excavation how ever once the material is excavated you are permitted to process it using machinery (ie. trommels and highbankers) [/*]
  • a highbanker is technically a sluice that uses a pump to transfer water to it and can be used anywhere a sluice can be used.[/*]

Goldmember91 where you from mate? certainly depends on your location if we can confim without a doubt, QLD is a bit iffy and debatable Vic, NSW, WA, SA no worries
