An emp is an environmental management plan isn't it? If so then unless something in it specifically stops you from fossicking then it shouldn't change anything, if it hasn't been approved yet then it should be pretty meaningless either way.

If your talking about an exploration lease then that doesn't prevent fossicking, it just gives a company rights to explore those areas, though it will cause problems if you want to make a claim as you wouldn't be able to without their approval.

May need to check your state laws though as in Queensland an exploration lease doesn't mean anything to a fossicker, but l think you may need government approval or notification in western Australia to access the land(not an issue if you already own it).

Yes you can fossick according to the State you're in rules/laws.
I.e. Victoria you would still need a miners right, Qld fossicking licence, NSW no miners right/permit/licence required etc. - all states will though have different rules for allowable depth, quantities, processing etc. but are basically restricted to using hand tools for excavation.
